This Krusteaz Privacy Policy explains how information about you is collected, used and disclosed by Continental Mills, Inc. dba The Krusteaz Company, and its subsidiaries and affiliated companies, including but not limited to WildRoots Foods LLC, SC Foods Holdings, Inc., and Sun Country Foods, Inc. (collectively, “Krusteaz,” “we” or “us”). This Privacy Policy applies to information we collect when you access and use our websites or when you otherwise interact with us through our websites or on other sites where we post this Privacy Policy.

Certain states, including California, Virginia, Texas, Connecticut, and Colorado (collectively, “Applicable States”), require additional information regarding our privacy practices and your privacy rights. Depending on whether you are a resident of those states (“Consumer”), you may be entitled to receive additional notices about our privacy practices and to exercise additional consumer rights relating to your personal information or personal data, as defined under those laws. INFORMATION YOU PROVIDE TO US

We collect information you provide directly to us. For example, we may collect information when you create an account, participate in any interactive features of our websites, create a profile, purchase our products, provide us with feedback or a product review, communicate with us via third party social media sites, participate in a contest or promotion, apply for a job with us, or otherwise communicate with us. You are responsible for verifying the accuracy of the personal information you submit to us and ensuring that any personal information that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use our websites, the information you receive when using our websites, and our ability to contact you.

INFORMATION WE COLLECT AUTOMATICALLY

When you access or use our websites, we (and the data analytics providers, advertising networks, and retail partners that we engage as service providers) may automatically collect information about you, including:

We share some or all of your personal information with third parties such as service providers for the business purposes listed above, to the extent permitted by applicable laws. We require that our service providers and contractors refrain from combining the personal information of opted-out consumers that such service provider or contractor receives from us with any personal information about you that the service provider or contractor obtains in any other manner, as required by law.

DISCLOSURE OF INFORMATION

We may disclose information about you as follows or as otherwise described in this Privacy Policy:

  • With your consent or at your direction;
  • With vendors, consultants and other service providers who need access to such information to carry out their work on our behalf, such as fraud prevention, customer service, and marketing and advertising;
  • When you provide a product review on our websites, your review is posted publicly, and any information you submit is also disclosed on our public website. We may also disclose your product review with third parties that syndicate this content for publication on retailers’ websites;

We may also process your personal information to generate aggregated and de-identified information. We take reasonable measures to ensure that such information cannot be associated with a consumer or household; we also maintain and use such information in its deidentified form and do not to attempt to reidentify the information, except as permitted by applicable law. As such, such aggregated or de-identified information may not be subject to this Privacy Policy if it cannot reasonably be used to identify you.

USAGE INFORMATION

To help us understand how you use our services and to help us improve them, we automatically receive information about your interactions with them, such as the length of time you spend on a page, the objects you click on, and the dates, times, and lengths of your sessions. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience.‍

Note that we may use information about you to create and use anonymous, statistical or aggregated data. Such aggregated data does not allow any party to identify you or any other specific user, and is not personal information subject to this Privacy Policy. We do not collect, use, or disclose sensitive personal information unless it is specifically submitted by you. To the extent that you submit any sensitive personal information for our collection, our use of such sensitive information will be limited to that use which is necessary to provide our services to you and/or for the uses to which you have consented. We retain personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Privacy Policy. We will delete personal information in accordance with our standard document retention schedules and as required by applicable laws.

CALIFORNIA AND OTHER STATE NOTICE OF INFORMATION COLLECTED AND/OR DISCLOSED

California law requires that we provide transparency about personal information we “sell” or “share.” ”Sale” for purposes of the CCPA, broadly means scenarios in which we have disclosed personal information to third parties in exchange for valuable consideration, while “sharing” means we have disclosed information to a third party for cross-context behavioral advertising. In addition, the CCPA has been interpreted to deem this “sharing” to also be a form of “sale.” We do not sell your personal information to other companies for money; however, we use your personal information for cross-context behavioral advertising to allow our advertising partners to collect certain information to show you targeted advertisements, which may be considered “sharing” under the California Consumer Privacy Act. EXERCISE OF CONSUMER PRIVACY RIGHTS

Subject to certain limitations, residents of the Applicable States have the right to (1) confirm whether we are processing your personal information, and to request to know more about the categories and specific pieces of personal information we collect, use, and disclose, including by obtaining copies of the personal information that we have collected, (2) request deletion of your personal information, (3) request correction of your personal information, and (4) not be discriminated against for exercising these rights.

We will verify your request by asking you to provide information related to your recent interactions with us, such as your name, email address, phone number and mailing address. We will not discriminate against you if you exercise your rights under applicable privacy laws. You also have the right to opt-out of sharing or targeted advertising at any time by clicking on the My Privacy Choices link in the footer of our website at https://www.krusteaz.com/.

We will address all verifiable consumer requests within the time periods required by law. If we require more time, we will inform you of the reason and extension period in writing. We may need to request specific information from you to help us confirm your identity and complete your request. This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information related to your request to enable us to process your request more efficiently. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We also reserve the right to refuse to fulfill any consumer rights requests for data that is not required to be provided under applicable laws.

If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. OPT-OUT PREFERENCE SIGNALS

Our website technologies are configured to recognize the Global Privacy Control opt-out preference signals, and will process such signals as valid requests linked to your browser to opt-out of the sale and commercial sharing of Personal Information for cross-context behavioral advertising purposes.  Note, however, that opt-out preference signals are specific to the settings of the browser or device you are using. You may need to opt out again if you elect to visit our Site from a different browser or device after opting out, or if you clear the cookies on which your opt-out preferences are based.

Children’s Privacy


We do not knowingly collect personal information directly from individuals under 13 years of age, and we do not have actual knowledge of selling personal information of individuals under 13 years of age. Our services are not intended for individuals under 13 years of age. No one under 13 years of age should submit or post personal information through our websites.

CALIFORNIA NOTICE OF FINANCIAL INCENTIVE

California’s privacy law requires that we notify you if we provide you a program, benefit, or other offering, related to the collection, deletion, or sale of personal information, which it defines as a “financial incentive.” We offer promotions and incentives to prospective and current Krusteaz consumers. Sometimes, consumers sign up or provide us their personal information (e.g., email address) in order to receive product incentives or participate in promotions. As such, under the CCPA, our product incentives or promotions may be considered financial incentives provided in exchange for the collection and retention of personal information.

We offer these product incentives and promotions to enhance our relationship with you or so you can engage with us while receiving some of these benefits. There is no obligation to opt-in and consumers may opt-out at any time. The details of each program are contained in each such program offering.

The consumer data received in exchange for your participation is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any offerings and whether and to what extent you opt out of any offerings but is roughly equivalent to the value of the product incentive or promotion offered.
